Manuel Guţan: Un cas roumaine d’acculturation juridique: la Délégation du Conseil départemental (1864-1936)
SUMMARY The law in modern Romania has been built, in the field of public as well as of private law, by means of an irrational legal import, determined by the prestige of the Western legal systems and by the emergency of the internal reforms. Unfortunately, despite all – natural – efforts to adapt the imported legislation to the Romanian legal culture, the “irrational” appeal to legal import, especially from the French-speaking legal space, was a constant element of the evolution of the Romanian public law. The institution of « the Permanent Delegation (Commission) of the Departmental Council” excellently reflected a particular way of thinking, where the intrinsic force of the national legal discourse was set aside by the political elite’s need of legitimation. |
