Brevi note in tema di administratio peculii: un concetto classico o un’introduzione giustinianea?

The expression administratio peculii evokes the power of the slave to put in place, with reference to the assets of the peculium, transfers or performances valid and effective according to the Roman legal system, binding for the dominus and thus completely satisfactory for the third party who had negotiated with the alieni iuris people. In particular, the texts seem to indicate that the power to effectively dispose of peculium’s goods should have been expressly granted to the slave by the dominus. The Romanistic doctrine, however, debates the traceability to the classic jurisprudence of the distinction between the concepts of concessio peculii and concessio liberae administrationis as emerging from Digest’s texts, in which seems to glimpse a possible intervention by Justinian’s compilers.
