<p>Since ancient times, the concept of <em>merx peculiaris</em> has been studied by jurists. That, in
order to identify the economic activities whose exercise by the slave would have entitled
creditors to sue the <em>dominus</em> based on the <em>actio tributoria</em>. The exegesis of D.14.4.1.1 and
its comparative analysis with other texts of the Digest allow us to reconstruct the
evolution concerning the identification of the economic application sphere of the edict <em>de
tributoria actione</em>. Through the <em>interpretatio</em> of <em>verba edicti</em>, the classical roman
jurisprudence gradually expanded the protection guaranteed by the edict, leading to possibly
extend it to all commercial activities.</p>
